Does My Deck Project Require a Permit?

Yes. Within the Hamilton County Plan Commission’s jurisdiction, the only projects that do not require a building permit are replacement of windows and doors, interior decorating, exterior painting, and shingle replacement. Every other structural improvement, repair, or addition requires a permit — including new decks, deck additions, and rebuilt decks.

Decks are classified under the Accessory Structure permit type in Hamilton County. All work must comply with the 2020 Indiana Residential Code. Building without a permit triggers a penalty of up to three times the standard fee, depending on the number of offenses.

What to Submit: The Accessory Structure Permit Package

1. Completed ILP / Building Permit Application

The application must be signed and dated. Include the property owner’s full mailing address, phone number, and email, plus the same information for the contractor. Also include the Parcel ID number for the property and a copy of the recorded deed.

2. Site Plan — Two Copies

Submit one hard copy (maximum 11″x17″) and one PDF. The site plan must be drawn to scale and show:

  • Outline of the entire property with property line dimensions
  • All easements on the parcel
  • Location of the septic tank and field, well, and driveway — critical on rural parcels
  • Location of all existing site improvements: buildings, mini-barns, parking areas, pools, lakes, etc.
  • The proposed deck drawn in its location, with dimensions
  • Setback distances from the proposed deck to all property lines
  • Hamilton County Surveyor sign-off on drainage approval — this is a separate required step unique to rural county properties

3. Construction Documents — Two Copies

Submit one hard copy and one PDF. Construction drawings must include:

  • Foundation plan showing footing sizes and depths, pier footing locations, and all dimensions
  • Floor plan showing all framing members with size, spacing, grade, and species of lumber — include direction of span
  • Wall sections or building sections showing all building materials, finish grade location, and footing/foundation dimensions and depth below grade
  • Building elevations showing all sides of the structure
  • Location and height of all required guardrails and handrails per Section R311.5.6.1 and R312 of the 2020 Indiana Residential Code
  • Truss design drawings with a registered Indiana architect or engineer’s seal, if manufactured trusses are used

4. Hamilton County Surveyor Drainage Sign-Off

Drainage approval from the Hamilton County Surveyor’s Office is required as part of the site plan. On rural parcels with septic systems and private wells — common across the Arcadia and Strawtown areas — drainage plans can affect where a deck can be placed and how footings are located. Contact the Surveyor’s Office early in your project to avoid delaying permit submission.

Applying Online vs. In Person

Rural Property Considerations: What’s Different in Northern Hamilton County

  • Septic and well locations are required on your site plan. Unlike suburban lots on city sewer and water, rural parcels commonly have private septic systems and wells. Your site plan must show these, and deck footings must clear the septic field and drain lines.
  • Drainage approval is an extra step. The Hamilton County Surveyor sign-off on your drainage plan is a separate coordination step before your site plan is complete. Allow extra time for this on rural parcels with more complex drainage situations.
  • Larger lots mean more options, but setbacks still apply. Rural lots are often much larger than suburban ones, but the zoning ordinance still sets minimum setback distances from property lines.
